Refund & Warranty Policy – Common Rail Cowboys

This Refund & Warranty Policy ("Policy") applies to all purchases from Common Rail Cowboys (ABN 60 640 110 112), unless stated otherwise.

1. Overview & Relationship with Australian Consumer Law

  • This Policy sets out our refund and warranty terms and operates in addition to your rights under the Australian Consumer Law (ACL). Nothing in this Policy limits or excludes any rights or remedies you may have under the ACL.
  • Proof of purchase is required for all claims. We may also request vehicle details, odometer readings, service history and diagnostic information.

2. Your Rights Under the Australian Consumer Law

  • Our goods and services come with guarantees that cannot be excluded under the ACL.
  • If a product has a major failure, you are entitled to a replacement or refund and compensation for any reasonably foreseeable loss or damage.
  • If a product has a minor failure, we may choose to repair, replace or refund the product within a reasonable time.
  • Where the ACL applies, it prevails over any inconsistent term in this Policy.

3. Change of Mind & Discretionary Refunds

  • We do not offer refunds or exchanges for change of mind, incorrect selection, fitment assumptions, or if the product is no longer required.
  • In rare cases and at our sole discretion, we may approve a discretionary return. Where approved:
    • a 25% restocking fee applies;
    • return freight and insurance are your responsibility;
    • items must be unused, uninstalled and in original resalable condition.

3A. Custom-Made, Painted & Personalised Products

Some products supplied by Common Rail Cowboys are custom-made, painted, colour-matched, fabricated, built-to-order or otherwise personalised ("Custom Products").

  • No change-of-mind refunds: Custom Products cannot be cancelled or refunded once production has commenced.
  • Non-refundable labour: Labour, paint, fabrication, machining and preparation costs are non-refundable except where required by the ACL.
  • ACL rights unaffected: This clause does not limit your statutory rights.

3B. Supplier-Sourced & Third-Party Stocked Items

Some products sold by Common Rail Cowboys are sourced directly from third-party suppliers or wholesalers and are not held in our own inventory. In some cases, the return or refund policies of those suppliers may restrict our ability to accept returns or offer exchanges on such items.

Where a product is subject to supplier return restrictions, we will advise you of this at the time your claim is lodged. This does not affect your rights under the Australian Consumer Law — if a product has a major or minor failure as defined under the ACL, your statutory remedies remain available regardless of supplier terms.

This clause applies to change-of-mind and discretionary returns only, and does not limit any ACL guarantee.

3C. Promotional Free Gifts & Bonus Parts

From time to time, Common Rail Cowboys may offer free gifts or bonus parts with qualifying purchases ("Promotional Items").

  • Where a Promotional Item has been included with an order, the retail value of that item may be deducted from any refund amount if the qualifying product is returned.
  • The retail value of any Promotional Item will be clearly stated at the time of the promotion.
  • Promotional Items are subject to stock availability and may be withdrawn at any time without notice.
  • Promotions are valid for the advertised period only and are available to eligible customers as specified in the promotional terms.
  • This clause does not limit your rights under the ACL.

3D. Order Cancellations

  • Orders cannot be cancelled once they have been dispatched.
  • For stocked items that have not been packed, dispatched or specially ordered, cancellations may be accepted at our discretion. Any refund will be less any unrecoverable costs already incurred.
  • Where payment processing costs have been incurred, unrecoverable payment processing fees may be deducted from any discretionary cancellation refund.
  • Where an order has been packed, freight has been booked, payment processing costs have been incurred, or handling/admin work has commenced, a cancellation fee of up to 5% of the order value may apply.
  • For supplier-sourced, special-order, backordered or third-party stocked items, a cancellation fee of up to 10% of the order value may apply once the item has been ordered from the supplier, unless our actual supplier, freight, payment processing, handling or restocking costs are higher.
  • Custom-made, painted, fabricated, machined, built-to-order, modified or personalised products cannot be cancelled once production, procurement, paint, fabrication, machining or preparation has commenced.
  • Any cancellation fee will be limited to our reasonable costs and losses incurred as a result of the cancellation, including payment processing fees, supplier charges, freight, handling, administration, paint, fabrication, machining or preparation costs.
  • This clause does not limit your rights under the Australian Consumer Law.

4. Products Damaged in Transit

  • Transit damage must be reported as soon as possible after delivery.
  • All packaging must be retained and clear photos provided.
  • Shipping Protection claims are handled in accordance with the Shipping Protection terms.
  • If Shipping Protection was not purchased, remedies depend on the carrier and ACL obligations.

5. Warranty Coverage – General

To the extent permitted by law, our warranty is limited to repair, replacement or refund of the product, at our discretion.

Unless required by the ACL, our warranty does not cover:

  • labour, installation, tuning or removal costs;
  • diagnostic or inspection fees;
  • vehicle downtime or loss of income;
  • towing, storage or hire vehicle costs;
  • indirect or consequential loss, including but not limited to engine damage, additional repair costs, loss of vehicle use, loss of income, accommodation, towing or recovery expenses.

5.1 General Warranty Conditions & Exclusions

Warranty does not apply where failure is attributable to:

  • misuse, abuse, neglect or incorrect installation;
  • incorrect tuning, calibration or ECU configuration;
  • poor maintenance or contamination;
  • fuel quality issues, contaminated fuel, or use of non-compliant diesel;
  • modification or unauthorised repair;
  • failure caused by another component or vehicle system;
  • failure of engine components including but not limited to pistons, head gaskets, cylinder heads or bearings, regardless of whether such failure occurs in proximity to the use of our parts;
  • use in motorsport, racing, extreme off-road, marine or industrial applications unless expressly agreed in writing;
  • Boost / intake leaks: Damage caused by operating the vehicle with boost, intake or intercooler leaks is not covered.

We may require evidence of correct installation as a condition of any claim, including but not limited to photographs, workshop invoices or installer details. Where installation was performed by a third party, we may contact that party directly.

6. Injectors & Common Rail Parts

  • Our goods come with guarantees that cannot be excluded under the Australian Consumer Law.
  • Warranty does not cover contamination, fuel quality issues, incorrect installation, or tuning outside safe limits.
  • Nozzles are non-refundable once supplied.
  • Warranty does not apply to competition, highly modified or non-OEM applications unless agreed in writing.

7. Pistons & Engine Components

  • Our goods come with guarantees that cannot be excluded under the Australian Consumer Law.
  • Cracked, damaged or failed pistons are not covered where failure is attributable to detonation, pre-ignition, lean fuelling, excessive boost, overheating, incorrect installation, or tuning outside safe limits.
  • A tune file or dyno sheet may be requested as part of any warranty assessment.
  • Known platform-specific design limitations — including but not limited to the 1KD-FTV's known susceptibility to piston cracking under standard and elevated cylinder pressures — are outside our control and do not constitute a product defect.

8. Turbocharger Warranty

  • Our goods come with guarantees that cannot be excluded under the Australian Consumer Law.
  • The turbocharger must be returned unmodified for inspection.
  • Labour, removal, refitting and tuning costs are not covered.

Warranty may be void where:

  • the turbocharger is not correctly pre-oiled and primed at installation;
  • the turbocharger is not manually re-primed with oil where the engine has not been run for an extended period, including after storage, engine repairs, oil system work, or delayed first start;
  • oil return orientation is incorrect;
  • foreign material or sealant is present;
  • oil starvation, overspeeding or overheating is evident;
  • boost leaks, incorrect boost control or unsuitable ECU calibration are present;
  • the turbo has been tampered with or repaired by an unauthorised party.

9. Shipping Costs for Returns

  • Where a defect is confirmed under the ACL, reasonable return freight will be covered as required by law.
  • If no fault is found or the issue is externally caused, you are responsible for all shipping and testing costs.

10. Claim Process & Response Time

  • Claims must be lodged in writing within a reasonable time of fault discovery.
  • Products must be returned within 30 days of fault discovery to allow proper assessment. Delays in returning goods may affect our ability to determine the cause of failure.
  • Assessment is typically completed within 7–14 business days.

10.1 Assessment, Testing & Cost Recovery

  • If a product is found not faulty or affected by external causes, you are responsible for inspection, testing and freight costs.
  • We may invoice these costs and require payment prior to return of the item.

11. Limitation of Liability

To the extent permitted by law, liability is limited to repair, replacement or refund of the product.
